Jeffrey Carter, a 45-year-old garbage truck driver, severely injured his back and neck after picking up a garbage can filled with water.

When an Iowa deputy workers? compensation commissioner found the company and its owner, James L. Watts, were responsible, Watts was ordered to pay weekly benefits for the injury, interest and prior medical expenses. But he never did.

Carter was fired, and he has not worked since. In May, he had surgery on several vertebrae, and he?s currently unable to move his neck.

?It?s been hell,? Carter said. ?I had to go on food stamps, I have no money coming in. And I lost my mobile home because I could not make payments.?

Those who represent injured workers say they fear Carter will never get paid, and worry about the message that sends to other corporate lawbreakers.

?There needs to be a message ? that the state will come after you. This is a felony, after all,? said Andrew Mertens, a spokesman for the Iowa Association of Justice. ?These are laborers by and large. And when they are restricted from working, they don?t just lose their jobs. They lose their ability to earn income all together.?

The Iowa attorney general?s office vowed this spring to pursue court action against James Watts after workers? comp officials and attorneys complained that the garbage hauler has failed for years to insure haulers who later were seriously injured.

Mertens said he hopes prosecutors don?t back down. He is one of several who have argued that the attorney general?s office needs to make examples of those who fail to carry workers? compensation or self-insure. In recent years, the state has yet to prosecute anyone.

One case currently under scrutiny by the attorney general?s office involves Russell Vanhorn, a 55-year-old garbage truck driver who worked for Watts? Hawkeye Waste Systems in Iowa City. Vanhorn fell 8 feet while attempting to tie down a tarp on a roll-off trash container in 2009.

The fall left him with severe abdominal pain. He was vomiting blood and required hospitalization and surgery, state records show.

After Vanhorn resigned in 2011, a deputy workers? compensation commissioner found Vanhorns injuries were not reported by the company as they should have been under law. The company acknowledged more than once that it did not have insurance to cover workers? compensation liabilities.

This month, another deputy commissioner ordered the company to pay Vanhorn disability benefits and a $25,000 penalty.

And state records show there are other hauler disabilities that have been ignored:

In 2008, Richard Lint, 53, a hauler for Watts? A-1 Disposal Services for four years, suffered a partial disability after his shoulder was struck by part of a front-loading garbage truck, a deputy worker?s compensation commissioner found. He was never paid, according to the workers? compensation division.

Mertens said Watts has shown a pattern of taking advantage of workers and renegotiating settlements with the state ?to basically manipulate workers out of money they deserve.?

?With actions like that, there?s no telling how many have been manipulated out of claims altogether.?

Carter said his paychecks routinely bounced after he started working for LM in March 2009. During that time, the state Department of Transportation also removed licenses from trucks because license fees went unpaid, he said.

?But I worked there a year and half because I needed a job at the time.?

Carter?s lawyer, David O?Brien of Cedar Rapids, said he attempted to collect both from the business and Watts personally, but he has failed.

Laura Liegois, solid waste manager for the city of Muscatine, said she is surprised the state has allowed Watts? companies to go so long without workers? compensation coverage.

?This is a very dangerous industry,? she said.

Kettering Health has posted more hiring announcements online each month than any other single local employer since the state started keeping track Oct. 2011. ?

Staples was second locally, with 206 online job advertisements in the same time period and Community Mercy Health Partners was third with 125. ??

By occupation, the job with the most advertised openings in the region from March to April was for truck?drivers?with 762 jobs posted. A retail salesperson was the occupation with the second most job openings of 545, followed by registered nurses at 517.

ScienceDaily (May 22, 2012) ? A team of University of Hawaii Cancer Center scientists led by James Turkson, Ph.D. have created a new type of anti-cancer drug named BP-1-102. The drug, which can be orally administered, targets a key protein that triggers the development of many types of cancer including lung, breast and skin cancers.

The development of BP-1-102 was guided by the research teams computer based molecular analysis of the cancer causing Stat 3 protein that causes cancer by promoting abnormal cell growth in otherwise healthy cells.

"The molecular structure of the hyperactive Stat3 protein basically resembles two cars that are joined together side-by-side," said Professor Turkson. "We then utilized a computer program that creates molecular models of potential drugs engaging in binding to the Stat3 protein to craft the BP-1-102 drug which literally pulls apart the Stat3 protein rendering it ineffective in causing cancer."

A unique feature of BP-1-102 is that it remains highly effective against cancer even when administered in oral form. Presently, most anti-cancer drugs require intravenous (IV) administration in a clinic or hospital setting which increases the financial, physical and emotional burdens on cancer patients. In its experimental form, BP-1-102 has shown promise in treating breast and lung cancers.

Currently, breast and lung cancers are two of the most commonly diagnosed cancers accounting for nearly half a million cases per year in the United States with over 200,000 deaths attributed to these diseases. In Hawaii, there is an average of 1500 cases diagnosed and over 600 deaths attributed to breast and lung cancers every year.

Professor Turkson is a recent and welcomed addition to the UH Cancer Center faculty. His innovative and ground breaking research focuses on developing novel anticancer drugs based on targeting signal transduction and apoptosis pathways.

NFL passes new pad rules for players

ATLANTA (AP) ? The NFL made thigh and knee pads mandatory equipment for the 2013 season, something the players' union was not pleased with.

Atlanta Falcons president Rich McKay, chairman of the competition committee, said Tuesday at an owners meeting that because this is a playing rule, the league can apply it unilaterally.

"We have a vote of the membership and can implement," McKay said. "Some of us felt we were remiss that we took it out of the rule book ? high school and college makes it mandatory ? and in our mind that is how it should be and will be in 2013.

"We have some work to do with the union."

McKay said the league will meet with NFL Players Association representatives on the issue, something they have discussed in the past.

But the NFLPA argued that the move should be negotiated.

"Any change in working conditions is a collectively bargained issue," the union said in a statement. "While the NFL is focused on one element of health and safety today, the NFLPA believes that health and safety requires a comprehensive approach and commitment. We are engaged in and monitor many different issues, such as players' access to medical records, prescription usage and the situation with professional football's first responders, NFL referees.

"We always look forward to meeting with the NFL to discuss any and all matters related to player health and safety."

The pads rule would not go into effect on the field until next year so equipment manufacturers can work on safety and comfort.

Commissioner Roger Goodell couldn't see any negatives to adding the thigh and knee pads.

"We have raised the issue of mandatory pads for at least three years now," he said. "I believe the technology has improved, the pads are far better than a decade ago, they allow better performance and are more protective. Every other level of football uses the pads."

Former All-Pro safety Troy Vincent, now an NFL vice president, explained why there could be pushback from the players.

"It's psychological. Less pads you are faster, skinnier, that's just the way I was introduced to the (pro) game," he said. "It's a culture shift. They will adjust."

Goodell pointed out something a Nike executive told him recently: NBA players are wearing more pads from the hips down than NFL players.

"There is something wrong with that," Goodell said.

Should a player not have the pads on when he enters a game, he will be sent off the field by a game official.

"It's the same as if he ran on without a helmet," McKay said. "It is a safety rule."

Goodell said he expects evidence in the Saints bounties case would be made public after all the player appeals and grievances have been heard. Release of any documents also could be delayed by Saints linebacker Jonathan Vilma's defamation lawsuit against Goodell after the commissioner suspended Vilma for the entire 2012 season.

The owners also voted to move the trading deadline from after Week 6 to after Week 8, and to allow one "marquee" player placed on injured reserve to return to practice after the sixth week of the schedule and to the lineup after the eighth week. That player must be on the 53-man roster after the final preseason cut.

Terrell Suggs, the 2011 Defensive Player of the Year, could fall into that category. Suggs recently underwent surgery for a torn Achilles tendon. If the Ravens believe Suggs can make it back in midseason, as the linebacker has predicted, they could use the IR special designation for him.

New England Patriots owner Robert Kraft likes the adjustment because he knows firsthand how devastating an injury to a star player can be.

"It's good because I think it keeps the excitement in the game," Kraft said. "I know when we lost Tom Brady there was a feeling he could have come back at the end of the year. It would have been great for the fans, and I think every team has someone in that category."

Goodell said the league is closer to a decision on what to do with the Pro Bowl, which he called "not a competitive game" last January. He wants more discussions with the players about how to improve the quality of the game, but dropping it entirely still is possible.

"The issue is we recognize it is an all-star game, but we also believe fans expect more from an NFL game," he said. "If we believe we can achieve that, we want to give them every opportunity to do that."

Only New Orleans, site of next year's Super Bowl, and Honolulu are being considered if the Pro Bowl is held.

The league approved the Buffalo Bills playing one regular-season game every year from 2013-17 in Toronto, extending that international series. Expansion of the international series in London could come as early as next year, Goodell added.
